Organizer

This competition is being held by TAMARA COMOLLI Fine Jewelry GmbH, Tegernseer Strasse 23, 83703 Gmund, Germany (hereinafter referred to as “Organizer” or “TAMARA COMOLLI”). Facebook and/or Instagram are not involved in the competition in any way and are not sponsoring, supporting or organizing it. Facebook and Instagram are expressly exempted from any responsibility. Any queries concerning the competition must be directed to the Organizer.

Eligibility to enter

The competition is open to individuals aged 18 years and over. Multiple entries are excluded. Any employees of TAMARA COMOLLI and their relatives, along with all employees who are or were involved in creating or processing the competition and their relatives, are ineligible to enter. Entry is only open to entrants residing in Germany and/or the USA.

Competition terms

The competition is free to enter and will be run exclusively via our newsletter, website, Instagram and Facebook from November 29 to December 13, 2021. All entrants who use the comment function to post #tamaracomolli or the form provided via the newsletter or website during the competition period will be entered into the competition. The winners will be drawn at random and notified in writing.

Competition processing

One stay at the Vila Vita Parc Resort & Spa, Althoff Seehotel Überfahrt and Spa & Resort Bachmair Weissach respectively will be raffled among all entrants who are of age and comment under the competition posts using #tamaracomolli or use the entry form on the website. Subject to availability, the dates for travel can be freely selected during 2022 (excluding the stay at Bachmair Weissach, which can only be booked outside of the Bavarian holiday periods). The prize cannot be paid out in cash, exchanged or transferred to another person. The winner can choose to forfeit their prize. In this case, another entrant will be drawn at random. The winners will be notified of their winnings by email within 14 days after the end of the competition and asked for confirmation. If the respective winner does not confirm acceptance of the prize within a period of 30 days, the prize will be forfeited. If there is an issue with the contact options provided (e.g. incorrect address), the Organizer will not be obligated to find out the correct address. No liability will be assumed for notification of the winner.

Premature termination and exclusion of warranty

The Organizer points out that the availability and function of the competition cannot be guaranteed. The Organizer will be entitled to terminate the competition early if its implementation can no longer be guaranteed due to technical and/or legal reasons. These may include technical problems (viruses in the computer system, manipulation, errors in hardware and/or software, etc.), changes to the terms of use or other decisions. Entrants will not be entitled to any claims resulting from premature termination.

Legal recourse

Legal recourse for implementation of the competition is not permitted. The competition and terms and conditions of entry are subject to the law of the Federal Republic of Germany.

Liability

The exclusions and limitations of liability below shall apply for the Organizer’s liability, regardless of other legal eligibility criteria. The Organizer will be liable without limitations for damage caused by intent or gross negligence. Furthermore, the Organizer will be liable for the slightly negligent breach of essential obligations whose breach endangers achievement of the contractual purpose, or for the breach of obligations whose fulfillment enables proper implementation of the competition in the first place and the observance of which the contractual partner can regularly rely on. In this case, however, the Organizer will only be liable for typically foreseeable contractual damage. The Organizer will not be liable for the slightly negligent breach of obligations other than those specified above. These limitations of liability will not apply in the event of injury to life, limb and health, for a defect after assuming quality guarantees for the quality of a product or in the event of defects that were concealed fraudulently. Liability in accordance with the Product Liability Act will remain unaffected. If the liability of the Organizer is excluded or limited, this will also apply to the personal liability of employees, representatives and vicarious agents of the Organizer.

Special notice on privacy

Entry into the competition is subject to our privacy policy. We will use your data for the purposes of carrying out the competition and in particular to send out the prize. If you have issued your consent to do so as part of the competition, we will be permitted to use your data to send you tailored recommendations, offers and suggestions on TAMARA COMOLLI products and services by email, telephone and/or SMS. Your data will be treated confidentially and will not be passed on to any third parties. You can revoke your consent at any time by sending an email to customerservice@tamaracomolli.com. Deletion of data will disqualify you from entry in the competition and in any subsequent prize draw. You have the right to information on the personal data relating to you, to correction or deletion, to restriction of processing, to object to processing and to data transferability – each in accordance with the legal provisions. If the processing of personal data is based on your consent, you have the right to revoke this consent at any time without this affecting the lawfulness of the processing that was carried out based on your consent up until the time of revocation.
